Terms of use

Definition of Terms

Within these Terms of Use, the following terms are understood as defined below.

Application: Mobile application named First Sight App, enabling encounters in public places, available on the App Store and Google Play Store.

Conditions: All elements contained in the terms of use, privacy policy, and safety guidelines related to dating.

TOU: These Terms of Use.

Account: A personal space dedicated to the Member within the Application, which they access by registering and logging into the Application. It allows the Member to access the Services, manage the information available in their profile, and update it.

First Sight App Inc: A corporation with its principal address in the province of Quebec, registered with the Quebec Business Registry under the identification number 1180285984.

Member: A person holding an account on the Application.

Services: All services, whether paid or free, offered and available through the use of the Application, which facilitate in-person encounters between Members who are simultaneously in the same public place.

1. Introduction

By using the services offered via the Application, you (hereinafter, "you") unreservedly accept to be bound by these Terms of Use, to which you become a party, as well as by all the policies and guidelines set forth herein. Additionally, by using the Services of First Sight App Inc, you agree to comply with these Terms of Use, including additional policies named the Privacy Policy and Safety Guidelines.

If you refuse to subscribe to them unreservedly, you must refrain from using the Services described below. It is also important to review all our policies before completing the account creation process.

2. Modifications to the Terms of Use

2.1 Updates

First Sight App Inc. reserves the right to update the Terms of Use occasionally or to terminate its offered services.

First Sight App Inc will inform its users of updates to its Terms of Use via its application.

The user's action of continuing to use the application after the ToU update is considered an unreserved acceptance of the modifications made to the ToU.

If the user disagrees with one or more modifications to the ToU, they have the option to discontinue their use of the First Sight App and delete their account.

2.2 Immediate Application

Any new version of the Terms of Use will be immediately applicable to users of the First Sight App.

3. Governing Law and Dispute Resolution

3.1 Governing Law

These Terms of Use are subject to Canadian laws, excluding any conflict of law rules.

3.2 Dispute Resolution

In the event of a dispute, the Member agrees, before undertaking any other judicial or extrajudicial process, to directly contact First Sight App Inc in writing, via email at info@firstsightapp.ca, to attempt to resolve the dispute amicably.

In case of failure, any dispute concerning these Terms of Use or your use of the Services must be submitted to the judicial district court of Arthabaska and resolved in accordance with the applicable laws in the province of Quebec.

4. Account Eligibility

Before creating an account on First Sight App Inc, you must validate your eligibility to use our Services. Additionally, this section details what you are permitted and not permitted to do when using the Services, as well as your commitments regarding their use and the rights you grant to First Sight App Inc.

4.1 Eligibility Criteria for Creating an Account and Using Our Services

Only compliance with all the following conditions authorizes you to create an account and use the Services. By using our Services, you declare and guarantee that:

  • You are a natural person at least 18 years of age.

  • You are not acting on behalf of a company, partnership, or other business entity.

  • You seek to engage in an in-person dating process.

  • You seek to establish a serious relationship or create new friendships.

  • The applicable laws in your territory do not prohibit you from using our Services.

  • You have not committed, nor been convicted of, an offense related to criminal harassment, sexual crimes, or assault.

  • You are not registered as a sex offender in any national sex offender registry.

  • You have not created more than one account on our Services.

  • First Sight App Inc. has not previously removed you from our Services. If otherwise, written authorization must be issued by a member of the administrative team of First Sight App Inc. allowing you to create a new account after requesting it via email at info@firstsightapp.ca.

If, at any time, you cease to meet at least one of these requirements, your authorization to access our Services is automatically revoked, and you must immediately delete your account. We reserve the right to revoke your access to our Services without warning, and in such a case, no refund for the current period of Service use can be claimed.

5. Responsibilities and Commitments of the Member

5.1 You agree to:

  • Comply with these Terms.

  • Use the latest version of the Application.

  • Interact with other members respectfully, both within and outside our services.

  • Be respectful toward our employees when communicating with customer service representatives or any other team member.

  • Read and apply our Safety Guidelines.

  • Review updates to the ToU upon receiving an update notice.

  • Establish a strong password and take reasonable measures to protect the security of your login information.

  • Present truthful information in your profile and interactions with other members with authenticity.

5.2 You agree not to:

  • Make false statements about your identity, age, or professional situation.

  • Use the Services in a way that damages the Services or prevents their use by other users.

  • Use our Services for illegal activities.

  • Harass, stalk, intimidate, defame, or harm another member.

  • Publish or share Prohibited Content (detailed in Section 6 below).

  • Disclose another person’s personal information without their permission.

  • Solicit money from another member.

  • Use another member’s account.

  • Use our Services to finance a political campaign or influence an election outcome.

  • Disclose private or privileged information you are not authorized to disclose.

  • Use bots within the Application for contacting another Member.

The license granted to you under these Terms and any authorization to access the Services are automatically revoked if you engage in any of the aforementioned actions.

6. Prohibited Content

First Sight App Inc. prohibits uploading or sharing certain content. Additionally, First Sight App prohibits the use of its Services to encourage or facilitate illegal activities. In such a case, First Sight App Inc cannot be held responsible, in any capacity, for illegal actions subject to civil or criminal sanctions committed by its Members.

Uploading or sharing content that violates these Terms ("Prohibited Content") will result in the immediate suspension or termination of your account.

7. Protection of Our Members’ Personal Data

First Sight app places great importance on protecting your personal data and respecting your privacy. We invite you to review our Privacy Policy to understand how we handle your personal data. This Privacy Policy is available here.

8. Rules of Caution

Meeting new people is often enriching and exciting at the same time. However, it is your responsibility to exercise judgment and caution in your actions, both during online interactions and in-person meetings.

8.1 Online

  1. Do not disclose personal information to another member before getting to know them better. For example, do not share your home address, your children’s names, their school names, places you regularly visit, or any other information that could make it easy to locate you outside of where you and another Member are simultaneously present. It is best to wait until you know a person and verify the accuracy of certain details before sharing personal information.

  2. Never disclose your banking information and do not accept solicitations for money.

  3. Report any inappropriate or suspicious behavior, or any account suspected of being fake or providing false information. Here are some valid situations for reporting:

  • Account held by a minor

  • Aggressive or disrespectful messages

  • Inappropriate behavior during an in-person meeting

  • Fake profiles and accounts

  • Requests for money transfers

  • Solicitation for the sale or purchase of products or services

8.2 In-Person

All these guidelines apply when using our Services through the First Sight app, but they are also applicable in general life.

  1. It is recommended to establish an initial in-person contact in a public place where you are already simultaneously present with another Member, to get a first impression and verify the authenticity of that Member’s profile.

  2. When meeting another Member in a public place while you are already simultaneously present in the same location, it is crucial to remain in a visible area. Never choose an outdoor or indoor parking lot, a restroom, or any other isolated place as a meeting point. Always stay in areas visible to others.

  3. When leaving a location where you were publicly present, whether to go elsewhere or return home, walk in well-lit and safe areas or be accompanied.

  4. If you choose not to meet another Member while already simultaneously present in a public place and instead arrange a later in-person meeting, do so in a public place rather than a private residence.

  5. For first meetings with someone you have recently met, you may inform a friend of the meeting location and suggest they call you to check in.

  6. Consuming substances is not encouraged during first meetings. Stay clear-headed and set boundaries if needed.

  7. It can sometimes be difficult to say no, but always remember that you can leave a meeting if you feel uncomfortable or unsafe.

  8. Do not rely on the person you are meeting to arrange your transportation to or from the date.

The Member is solely responsible for verifying the authenticity of the identity of individuals they may decide to meet in a private or public location following an initial interaction through our Services. First Sight app cannot, under any circumstances, be held liable for any incident occurring during a meeting between two or more Members.

9. Reporting a Member

First Sight app encourages its Members to report any Member who may have engaged in inappropriate behavior or violated one or more guidelines outlined in these Terms. To facilitate this, First Sight app provides a reporting feature within its Services, allowing Members to quickly report a Member.

10. Disclaimer

First Sight app inc disclaims all liability related to any content that you or another Member posts, sends, or receives through our Services, as well as the accuracy of displayed profiles. This includes, but is not limited to, information regarding a Member’s identity, intentions, and the authenticity of users with whom you may interact through our Services. First Sight app does not conduct criminal background checks on its Members. Downloading and accessing any material through our Services is at your own risk. First Sight app also disclaims liability for any damage caused to your devices or IT equipment, including but not limited to security breaches, viruses, hacking, network failures, fraud, omissions, errors, or any other technical malfunction.

11. Deleting Your Account - Account Termination and Withdrawal Rights

If, for any reason, you wish to stop using our Services, you can delete your account at any time. To do so, access your account via the app by clicking on the icon represented by a silhouette at the far right of the bottom menu. Then click on Settings and select Delete My Account in the Application section.

If you delete your account or if First Sight app inc voluntarily deletes it for any reason, these Terms will continue to apply and remain in effect between you and First Sight app inc. Your information will be deleted in accordance with our Privacy Policy.
